Business Visa

Business Talent (Permanent) visa (subclass 132)

Features:

This visa allows you to establish a new or develop an existing business in Australia. It has two streams:

​

  • Significant Business History stream: for high-calibre business owners or part-owners who want to do business in Australia

  • Venture Capital Entrepreneur stream: for people who have sourced venture capital funding from a member of the Australian Venture Capital Association Limited (AVCAL).​

Visa allows you to:

It lets you and any member of your family unit who has also been granted this visa:

​

  • stay in Australia indefinitely

  • work and study in Australia

  • enrol in Medicare, Australia's scheme for health-related care and expenses

  • apply for Australian citizenship (if you are eligible)

  • sponsor eligible relatives for permanent residence

  • travel to and from Australia for five years from the date the visa is granted (after that time, you will need a resident return visa or another visa to return to Australia).

You might qualify for a Special Benefit from Centrelink if you suffer a major change of circumstances that is beyond your control.

Eligibility:

You must:

​

  • be nominated by a state or territory government agency

  • be invited to apply for the visa

  • have assets of AUD 1.5 million and business turnover of AUD 3 million (Significant Business History stream) or

  • have funding of at least AUD 1 million from an Australian venture capital firm (Venture Capital Entrepreneur stream)

Process times:

Venture Capital Entrepreneur:

  • 75 per cent of applications processed in 14 months.

  • 90 per cent of applications processed in 15 months.

Business Innovation and Investment (Provisional) visa (subclass 188)

Features:

You must:

​

  • be nominated by an eligible government organisation

  • be invited to apply for the visa

  • have experience in owning and operating a business (Business Innovation stream) or

  • have at least AUD 1.5 million to invest (Investor stream) or

  • have at least AUD 5 million to invest (Significant Investor stream) or

  • have at least AUD 15 million to invest (Premium Investor stream)

  • meet additional requirements of the relevant stream.

Visa allows you to:

This visa lets you:

​

  • establish a new or develop an existing business and/or invest in Australia, make a designated investment with an Australian state or territory government, make and maintain complying investments in Australia or participate in a complying entrepreneurial activity in Australia

  • travel in and out of Australia for the life of your visa

  • bring members of your family unit with you to Australia

  • seek permanent residence by applying for a Business Innovation and Investment (Permanent) visa (subclass 888).

Eligibility:

This visa lets you:

Business Innovation and Investment (Permanent) visa (subclass 888)

Features:

You must:

​

  • hold a relevant stream of the subclass 188 visa or 444 visa

  • be nominated by a state or territory government agency or Austrade

  • have owned and operated a business in Australia for at least 2 years (Business Innovation stream) or

  • have held a designated investment of AUD 1.5 million for 4 years (Investor stream) or

  • have held a complying investment of AUD 5 million for 4 years (Significant Investor stream) or

  • held a complying investment of AUD 15 million for 1 year (Premium Investor stream)

  • meet additional financial and other requirements of the same stream of this visa.

Visa allows you to:

The Business Innovation and Investment (Permanent) visa (subclass 888) allows you to manage your business and investments in Australia.

​

  • This is a permanent residence visa. It lets you and any member of your family unit who has also been granted this visa:

  • stay in Australia indefinitely

  • work and study in Australia

  • enrol in Medicare, Australia's scheme for health-related care and expenses

  • apply for Australian citizenship (if you are eligible)

  • sponsor eligible relatives for permanent residence

  • travel to and from Australia for five years from the date the visa is granted (after that time, you will need a resident return visa or another visa to return to Australia).

Eligibility:

You might be able to apply for this visa if:

​

  • you are the primary visa holder of a provisional Business Innovation and Investment visa (subclass 188) and have met all the requirements of your Business Innovation and Investment visa in the stream in which you first applied; or

  • are the secondary visa holder who is the spouse or de facto partner of a provisional Business Innovation and Investment visa (subclass 188) holder in the Investor or Business Innovation stream and can meet all the primary criteria requirements of the permanent Business Innovation and Investment visa in the relevant stream; or

  • you hold a Special Category visa (subclass 444) and have met the requirements of the business innovation stream; and

  • you and your partner have not been involved in any unacceptable business or investment activities.

​

Additional requirements are:

​

  • and your partner have a satisfactory record of complying with Commonwealth laws, and of each State or Territory in which you operate a business and employ employees in the business, relating to your business,

  • you have been nominated by an Australian state or territory or by Austrade on behalf of the Australian government,

  • you and all your family members meet health and character requirements – you do not need to prove this again if you have already done this for the provisional Business Innovation and Investment visa (subclass 188),

  • have a realistic commitment to maintain business or investment activities in Australia.

  • Other requirements depend on the stream in which you held your provisional Business Innovation and Investment visa (subclass 188).
